Welcome to Breathitation. Please read these Terms & Conditions carefully before using our app. By using Breathitation, you agree to be bound by these terms.

1. Acceptance of terms

By downloading, installing, or using the Breathitation application (the “Service”), you agree to these Terms & Conditions. If you do not agree, do not use the Service. Breathitation reserves the right to update these Terms at any time. When changes are made, we will notify users via an in-app notice or notification. Continued use of the Service after changes are posted constitutes acceptance of the new Terms.

2. Eligibility

You must be at least 13 years old to use Breathitation. By using the Service, you confirm that you meet this requirement. Users under 18 should have parental or guardian consent.

Breathitation does not knowingly collect personal data from children under the age of 13. If we become aware that a child under 13 has provided personal information, we will delete it promptly. If you believe a child under 13 has used the Service, please contact us through Settings > Support.

3. Health disclaimer & medical advice

Breathitation is a personal wellness tool designed to support relaxation, focus, and mindful breathing. It is not a medical device and does not provide medical advice, diagnosis, or treatment of any kind.

  • Breathitation is not a substitute for professional medical advice. Always consult a qualified healthcare provider before starting any breathing practice, especially if you have a pre-existing medical condition (e.g., respiratory, cardiovascular, neurological, or anxiety disorders).
  • Do not use the app as a reason to ignore, delay, or disregard professional medical advice. If you have concerns about your health, consult a doctor.
  • Breathing exercises may cause dizziness, lightheadedness, hyperventilation, tingling sensations, or temporary altered states of awareness. These are known risks associated with breathwork. If you experience any of these, stop the session immediately.
  • If you experience a medical emergency at any time, stop using the app and call your local emergency services immediately.
  • Do not use Breathitation while driving, operating machinery, in water, or in any situation where loss of attention or temporary dizziness could put you or others at risk.
  • Some breathing techniques may trigger heightened emotional states, anxiety, or discomfort in sensitive individuals. If this occurs, stop the session and seek appropriate support.
  • Breathitation makes no claims that its content treats, cures, or prevents any illness or condition.
  • The app is intended for general wellness purposes only. It is not a diagnostic tool and should not be used as a definitive health or medical solution under any circumstances.

4. User responsibility

By using Breathitation, you expressly assume all inherent risks associated with breathwork and breathing exercises, including but not limited to dizziness, lightheadedness, hyperventilation, and temporary altered states. Use the Service at your own risk.

All users, whether using the free version or a Pro subscription, are solely responsible for how they use the Service, including the frequency, duration, and intensity of breathing sessions.

By using Breathitation, you acknowledge and agree that:

  • You use the Service entirely at your own risk.
  • You are responsible for assessing your own physical and mental condition before and during each session. If you feel unwell at any point, stop immediately.
  • Breathitation provides breathing tools as a general wellness aid. How you choose to use them is your personal decision and responsibility.
  • Misuse, excessive use, or use beyond reasonable common sense (e.g., repeated sessions that cause dizziness, discomfort, or adverse effects) falls outside the intended purpose of the app and is solely your responsibility.
  • You must not use the Service in situations where reduced attention or temporary physical effects could be dangerous, including while driving, in water, or operating machinery.
  • Pro users who create custom breathing patterns take full responsibility for the patterns they design and use. Breathitation does not review, validate, or endorse user-created patterns for safety or physiological appropriateness. Extreme or improper patterns may carry serious health risks.
  • Breathitation and its developers are not responsible for any injury, health reaction, or harm of any kind, whether physical or psychological, that may result from using the app. This applies regardless of whether you were following a built-in preset or a custom pattern you created.
  • By continuing to use the Service, you confirm that you have read, understood, and accepted these risks.

5. Subscriptions & billing

Certain features of the Service require a paid Pro subscription.

  • Subscriptions are available on a monthly or annual recurring basis, or as a one-time lifetime purchase, all charged in advance.
  • All payments are processed through the Apple App Store or Google Play Store. Breathitation does not directly handle payment information.
  • Prices may change at any time. You will be notified of any price changes before they take effect.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
  • To cancel, go to your device's subscription settings (iOS: Settings > Apple ID > Subscriptions; Android: Play Store > Subscriptions).
  • Breathitation does not offer refunds for partial subscription periods, except where required by applicable law.
  • All purchases and subscription billing are processed by Apple App Store or Google Play Store. Their respective terms of service also apply to any transaction made through those platforms.

6. Privacy policy

Your use of the Service is governed by our Privacy Policy, which explains what data we collect, how it is used, and how you can control it. By using Breathitation, you also agree to the Privacy Policy.

7. Intellectual property

All content in Breathitation, including breathing presets, design, audio, ambient music, sounds, graphics, and code, is the original work and property of Breathitation and is protected by applicable intellectual property laws, including Chilean copyright law (Ley 17.336).

You may not copy, reproduce, record, download, redistribute, modify, or use any content from the Service, including audio and music, for any purpose outside of personal in-app use, without prior written permission from Breathitation. Unauthorized use of any original audio or music content from the Service or its associated channels is strictly prohibited.

8. User conduct

You agree to use the Service only for its intended purpose: personal wellness, relaxation, and breathing practice. You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or tamper with the app.
  • Use automated bots, scrapers, or scripts to access the Service.
  • Attempt to bypass or circumvent subscription or payment controls.

9. Third-party services

Breathitation uses third-party services to operate (e.g., payment processing, cloud infrastructure). These services have their own terms and privacy policies. Breathitation is not responsible for the practices of third-party providers.

10. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. Breathitation does not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components.

11. Limitation of liability

To the fullest extent permitted by law, Breathitation and its developers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service. This includes, but is not limited to, any harm resulting from breathing sessions, custom preset use, or reliance on app content.

In no event shall Breathitation's total liability exceed the amount you paid for the Service in the past 12 months.

12. Termination

Breathitation reserves the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

13. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Chile. Any disputes arising from the use of the Service shall be subject to the jurisdiction of Chilean courts, unless otherwise required by the laws of your country of residence.

14. Indemnification

You agree to defend, indemnify, and hold harmless Breathitation and its developers from and against any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your misuse of any breathing feature, including custom patterns.

15. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court, that provision will be removed or limited to the minimum extent necessary. The remaining Terms will continue in full force and effect.

16. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Breathitation regarding the use of the Service. They replace any prior agreements, communications, or understandings, whether written or verbal, relating to the Service.
